The Personal Data in our possession are protected and treated in accordance with the Federal Law on Protection of Personal Data Held by Private Parties, (hereinafter referred to as "the Law"), as well as the regulations and this Privacy Notice, so we ask you to read this Privacy Notice carefully.

In accordance with the Law, in case the Confidential Information includes: (i) personal data: any information concerning an identified or identifiable natural person, (ii) financial data: credit card number, proof of address, or any data that may reveal the economic capacity of a natural person or (iii) sensitive data: data that affects the most intimate sphere of a person and that may lead to discrimination such as origin racial or ethnic status, health status, genetic information, religious, philosophical and moral beliefs, trade union membership, political opinions and sexual preferences (personal, financial or sensitive data will be used interchangeably as "Personal Data"),

PURPOSE OF THE NOTICE.

In compliance with the provisions of the Law and its Regulations, we put at your disposal this Privacy Notice to publicize the terms and conditions for the processing of personal data that are collected over time that will be: legitimate, controlled, and informed, in order to guarantee your privacy, as well as your right to informative self-determination. In order to provide our services in an integral manner, THETEX HIVE S.A.P.I. (hereinafter referred to as "THETEX HIVE", "Company" or "Company"), may directly collect your personal data, voluntarily provided by you, also your data may be kept indirectly when information is obtained through publicly accessible sources or permitted transfers.

DEFINITIONS.

For the purposes of this Privacy Notice, the following terms shall have the meaning indicated below:

Client: Any natural or legal person, user, or client of the services provided by THETEX HIVE directly or indirectly.

Consent: Manifestation of the will of the owner of the data through which the treatment of the same is carried out.

Law: Federal Law on Protection of Personal Data Held by Private Parties.

Regulation: The regulation of the Federal Law on the Protection of Personal Data Held by Private Parties

Responsible: THETEX HIE, S.A.P.I.

PRINCIPLES BY WHICH WE ARE GOVERNED.

(i) legality: to treat Personal Data in accordance with and in compliance with the provisions of Mexican and international law;

(ii) consent: to process personal data only in accordance with the manifestation of the will of the owner;

(iii) information: respect the main characteristics of the processing to which the Personal Data will be subjected;

(iv) quality: ensuring that Personal Data is relevant and correct, i.e. ensuring that it is accurate and complete;

(v) purpose: Personal Data may only be processed in relation to the specific and legitimate purposes for which they were obtained;

(vi) loyalty: privilege the protection of the interests of the holder;

(vii) proportionality: ensuring that the processing of Personal Data is necessary, adequate, and relevant in relation to the purposes for which it was obtained; and

(viii) Responsibility: Ensure and respond to the processing of personal data in their custody.

TREATMENT, COLLECTION AND PURPOSE.

The personal information to which the Responsible has access will be used, according to provide the services and products you have requested, inform you of modifications, and specifically to: (i) contact you; (ii) provide the services we provide; (iii) create, upload and keep updated your profile in the database of the Responsible; (iv) provide our advisors, partners, clients, employees or professionals with the information necessary to carry out our activities; (iv) comply with the purpose of the relationship that has given rise to the processing of personal data, and where appropriate; (v) statistical purposes, quality control and customer satisfaction.

For the aforementioned purposes, we need to obtain the following personal data: name, address, email, telephone number, federal taxpayer registration, date of birth, nationality, identification, tax identification number, and/or any other identity number issued by a government; Financial details including details on the source of income, crypto wallet address, the type of information to identify activity on the website. In the case of being a legal entity, the data in our possession will be, name or company name, incorporation, and statutory documents, address, federal taxpayer registry, nationality, identification, a public registry of commerce, assemblies held by the client, people who have control, such as what they have the shareholding and the last beneficiaries, information related to the legal representative. We may also request information at any time for security reasons, identification, or by mandate of the competent authority in compliance with the corresponding legislation, mainly in the area of Prevention of Money Laundering and Financing of Terrorism.

This information is collected at different times, when: (i) prior to the contract in order to generate a profile of our client; (ii) at the time of preparing and entering into the contract; (iii) at the request of the authority.

OBLIGATIONS OF THETEX HIVE

1. a) Respect at all times the principles of (i) legality: treat Personal Data in accordance with and comply with the provisions of Mexican legislation and international law, (ii) consent: treat personal data only in accordance with the manifestation of the will of the owner, (iii) information: respect the main characteristics of the treatment to which the Personal Data will be subjected, (iv) quality: ensure that the Personal Data are relevant and correct, that is, ensure that they are accurate and kept complete, (v) purpose: Personal Data may only be processed in relation to the specific and legitimate purposes for which they were obtained, (vi) loyalty: privileging the protection of the interests of the owner, (vii) proportionality: ensuring that the processing of Personal Data is necessary, adequate and relevant in relation to the purposes for which they were obtained, and; (viii) Responsibility: Ensure and respond to the processing of personal data in their custody.
2. b) Maintain confidentiality and do not disclose in any way or by any means to third parties, or make use of Personal Data for purposes other than those for which they were communicated.
3. c) Respect the terms and conditions of the corresponding privacy notice and the consent of the owner of the Personal Data that THETEX HIVE will make available to third parties.
4. d) Have the necessary mechanisms and procedures to protect Personal Data in accordance with the levels required by the Data Law and the other provisions derived from it.
5. e) Inform the CLIENT in the timeliest manner, in the event of a security breach of the Personal Data provided by third parties to THETEX HIVE. Likewise, THETEX HIVE, in the event of a security breach, undertakes to take all corresponding legal measures arising from such event, including but not limited to drawing up the corresponding factual record and filing a complaint.

RIGHTS OF ACCESS, RECTIFICATION, CANCELLATION AND OPPOSITION (ARCO).

You at all times have the right to access, rectify, and cancel your personal data, as well as to oppose the processing thereof or revoke the consent that you have granted us for this purpose, through the procedures described below.

Exercise of the rights of Access, Rectification, Cancellation, and Opposition (ARCO) For the exercise of your rights of access, rectification, cancellation, and opposition to the processing of your personal data or to revoke consent, by requesting via email or at our address located in Mexico.

In compliance with Article 29 of the Law, said request must contain the following information:

I. Your name and address or other means to communicate the response to your request;

II. The documents that prove your identity or, where appropriate, the legal representation of the person making the request on your behalf;

III. The clear and precise description of the personal data with respect to which one seeks to exercise any of the rights mentioned in the previous paragraph, and

IV. Any other element or document that facilitates the location of your personal data.

In case of requesting the rectification of personal data, you must indicate the modifications to be made and provide the documentation supporting your request. The response to your request will be communicated within twenty (20) business days, counted from the date it was received, and may be extended to twenty more days in the cases established by law; In order that, if appropriate, the measures adopted to comply with your request are carried out, which will be carried out within fifteen working days following the date on which the response is communicated.

In the event that the information/documentation is erroneous or insufficient, THETEX HIVE may require the missing elements to process your request, within 10 (10) business days following receipt of your request. You will have 5 (five) business days to meet this request, counted from the day after you receive it. In case of not giving a response within this period, it will be considered not presented.

8. VALIDITY AND MODIFICATIONS TO THE NOTICE.

This Privacy Notice will enter into force from the date of its signature; the exercise of the rights of Access, Rectification, Cancellation, and Opposition may be made at any time in accordance with the Law.

THETEX HIVE reserves the right to make modifications or updates to this Privacy Notice at any time, due to legislation, internal policies, or new requirements for the provision or offering of our services and market practices. Any modifications will be published on our website page so we recommend that you periodically visit our website to stay informed about such updates or modifications.
